Terms of Service

The short version

  • Buying AutoOffload is a one-time payment for a perpetual license to use the app on your own devices. No subscription.
  • You get 5 free offloads to try it fully before you pay — so all sales are final. The one exception: if it won't run and we can't fix it, we refund you (see Refunds).
  • Payments are handled by Paddle as Merchant of Record. Please don't share, resell, or crack your license key.
  • AutoOffload verifies every copied file, but you stay responsible for keeping your own backups. The app is provided "as is".
  • These terms are governed by the law of Ontario, Canada. Questions: [email protected].

1. Agreement to these terms

AutoOffload (the “app”) and this website are operated by Alexander Specter (“we”, “us”, “our”). These Terms of Service (“Terms”) are a legal agreement between you and us that governs your download, purchase, and use of AutoOffload.

By downloading, installing, or using the app — including the free offloads — you agree to these Terms and to our Privacy Policy. If you do not agree, please don't use AutoOffload. You must be at least 16 years old, or the age of majority where you live, and able to enter into a binding contract.

2. Your license

When you buy AutoOffload, we grant you a perpetual, non-exclusive, non-transferable license to install and use the app for your own personal or business purposes, subject to these Terms. You may use it on the number of devices shown at checkout (your activation limit); you can move your license to a new machine if you replace or stop using an old one.

Free trial

Before any purchase, AutoOffload lets you complete 5 free offloads so you can confirm it works for your cameras, cards, drives, and workflow. The trial is the same app — there is no separate “lite” version — so what you test is exactly what you buy.

Updates

Your purchase includes updates and fixes we release for the version of AutoOffload you bought. A significant future release may be offered as a separate paid upgrade; if so, we'll make that clear before you pay for it. We're not obligated to keep developing or supporting any particular feature indefinitely.

3. Things you agree not to do

To keep AutoOffload sustainable and licensed fairly, you agree not to:

  • copy, resell, sublicense, rent, lend, or redistribute the app or your license key, or share your key to let others bypass paying;
  • reverse engineer, decompile, or disassemble the app, or attempt to extract its source code, except to the limited extent that applicable law expressly permits despite this restriction;
  • remove or alter any licensing, copyright, or attribution notices, or circumvent the trial limit, activation, or license checks;
  • use the app to break the law, or in a way that infringes someone else's rights.

We retain all rights in AutoOffload that we don't expressly grant you here. The app, its name, and its branding remain our property.

4. Pricing & payment

AutoOffload is sold as a one-time purchase. Pricing is shown on the site at checkout and may change over time (for example, our launch price may increase) — the price you see and agree to at checkout is the price that applies to your order.

Payments are processed by Paddle, which acts as the Merchant of Record — the seller of record that handles payment, applicable sales tax/VAT, and your receipt. Your purchase is also subject to Paddle's Buyer Terms. We never receive or store your full card details. All licenses are bought through Paddle's hosted checkout, on both macOS and Windows — the Windows app is distributed as a free download through the Microsoft Store, but licenses are never sold there.

After a completed purchase, your license key is delivered to the email you provide at checkout. Keep it somewhere safe — it's what activates the app and proves your purchase.

5. Refund policy

All sales are final. Because AutoOffload gives you 5 free offloads to evaluate the full app before paying, we do not offer refunds for a change of mind, an accidental purchase, buying the wrong product, or simply no longer needing it.

The one exception

If the app will not activate or run on a system that meets the stated requirements, and our support team cannot resolve it within a reasonable time, we'll refund your purchase in full. We'd much rather fix it than lose you — so reach out first and give us a chance to help.

To request a refund under this exception, email [email protected] from the address you bought with, within 14 days of purchase, and describe the problem and what you've tried. We'll respond promptly.

Nothing in this policy takes away rights you have under mandatory consumer law. If you're in the EU or UK, you may have a statutory right to cancel digital purchases — note that this right can end once you start using a digital download with your consent. Because Paddle is the Merchant of Record, approved refunds are issued through Paddle and are also subject to their policy.

6. Your files are your responsibility

AutoOffload is built to protect your media: it re-reads every file after copying and verifies it against the source with a cryptographic hash, and it won't eject or report success until a copy is confirmed. We take that seriously — but no software can guarantee against every hardware fault, failing card or drive, accidental deletion, power loss, or operating-system issue.

So, the golden rule still applies: keep your own backups and verify your important files before you wipe a card. You're responsible for choosing your source and destination drives and for maintaining redundant copies of anything you can't afford to lose. AutoOffload is a tool that helps you do this safely; it is not a substitute for a proper backup workflow.

7. Third-party services

AutoOffload relies on a few trusted providers. Your use of AutoOffload involves their services and terms:

8. Disclaimer of warranties

To the fullest extent permitted by law, AutoOffload is provided “as is” and “as available,” without warranties of any kind, whether express or implied — including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or compatible with every device, card, drive, or operating-system version.

Some jurisdictions don't allow the exclusion of certain warranties, so parts of this section may not apply to you; in that case, those warranties are limited to the minimum the law allows.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, photos, footage, profits, or revenue, arising out of or related to your use of (or inability to use) AutoOffload — even if we've been advised such damages were possible.

Our total liability to you for any claim relating to the app or these Terms is limited to the amount you actually paid us for your license in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law (such as for fraud, or for death or personal injury caused by negligence), or any non-waivable rights you have as a consumer.

10. Suspension & termination

These Terms and your license continue until terminated. Your license ends automatically if you materially breach these Terms — for example, by pirating, redistributing, or cracking the app. We may also disable a license key we reasonably believe is being shared or used fraudulently. On termination you must stop using the app and remove it from your devices. Sections that by their nature should survive (such as §3, §6, §8, §9, and §12) survive termination.

11. Changes to the app and these Terms

We may update AutoOffload and these Terms from time to time. When we change the Terms, we'll revise the “last updated” date above and post the new version here; significant changes will be highlighted. If you keep using the app after an update takes effect, that means you accept the revised Terms. If you don't agree to a change, stop using the app.

12. Governing law & disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute that isn't resolved informally — though this doesn't deprive you of the protection of mandatory consumer-law rights in your own country of residence.
